Terms of Service
Last Updated: October 12, 2026
These Terms of Service (“Terms”) govern your access to and use of Taplist.io and all other products and services offered by Splatboard LLC (“Splatboard,” “we,” or “us”), including our websites (taplist.io, splatboard.com, and mymug.club), our TV, mobile, and native applications, hosted menu and location pages, and Taplist.io Grow (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and to our Privacy Policy and Refund Policy, which are part of these Terms (together, the “Agreement”). If you do not agree, do not use the Services.
If you join a membership, club, or other subscription program operated by one of our customers — for example, through a page hosted at mymug.club — your membership is governed by our Membership Terms. Where they conflict with these Terms about such a membership, the Membership Terms control.

1. Who’s who
“You” means the individual or entity using the Services. If you use the Services on behalf of an entity, you represent that you have authority to bind it, and “you” includes that entity.
Our customers — the bars, breweries, restaurants, and other businesses that hold Taplist.io accounts — are “Businesses.” Some Services let a Business offer memberships, clubs, and other subscription programs (each a “Program,” for example a mug club) to its own customers and patrons (“Members”), and keep records about them. The information a Business stores about its Members and other patrons through the Services is “Customer Data.” Anything you or others post, upload, or display through the Services — menus, descriptions, images, Program pages, and the like — is “Content.”
2. Your account
You must be at least 18 years old, or the age of majority where you live, to create an account. You agree to provide complete and accurate information when you register and to keep it up to date. You are responsible for all activity under your account and for keeping your credentials secure; do not share them. Notify us immediately at https://taplist.io/support of any unauthorized use of your account.
When you create a Taplist.io account, we may contact you about our products and services. You can opt out of marketing messages at any time by following the instructions in the message or contacting us.
3. Acceptable use
You represent and warrant that your use of the Services:
- Will comply with these Terms and all applicable laws, including laws on online conduct, privacy, data protection, advertising, alcoholic beverages, and export controls and U.S. sanctions;
- Will not be used for unlawful purposes, to publish illegal content, or to send spam or unsolicited bulk messages;
- Will not infringe or misappropriate anyone’s intellectual property, privacy, or publicity rights, or disclose sensitive personal information about others;
- Will not copy, modify, reverse engineer, scrape, or build a competing product from the Services or their content, except as permitted by law or a written agreement with us;
- Will not resell, sublicense, or provide the Services to third parties as a service bureau, other than displaying your own menus and Programs;
- Will not structure your account to avoid fees, including by using one location license for more than one physical location or by choosing a plan you are not eligible for (see Section 5);
- Will not access the Services by automated means other than published APIs, attempt to probe, scan, or test the vulnerability of our systems, interfere with or disrupt any service or network, or overburden our systems as determined by us in our reasonable discretion; and
- Will not create, distribute, or enable malware, spyware, or other malicious code.
4. Your content
Responsibility. You are entirely responsible for the Content you post and any harm resulting from it. We do not review all Content and do not endorse it or represent that it is accurate or non-harmful. Content posted by others is that person’s responsibility, and we are not a party to disputes between you and them.
License. We do not claim ownership of your Content. You grant us a worldwide, royalty-free, non-exclusive license to host, store, reproduce, modify (for example, to resize or reformat), display, and distribute your Content solely as needed to provide, operate, secure, improve, and support the Services — for example, displaying your menus on your screens and your Program pages on mymug.club. We will not use your Content for publicity or marketing without your permission. This license does not apply to Customer Data, which we handle only as described in Section 7 and our Privacy Policy. We may disclose or preserve Content as needed to enforce the Agreement, comply with law, respond to claims that Content violates third-party rights, or protect the rights, property, or safety of Splatboard, our customers, or the public.
Feedback. If you send us suggestions or feedback, you agree we may use them without restriction or compensation.
5. Paid Services
Fees and renewal. Some Services are offered for a fee (“Paid Services”). By using a Paid Service you agree to pay the fees shown when you subscribe. Recurring fees are billed in advance at the start of each billing period (monthly or annually) and renew automatically until you cancel. You can cancel at any time from your account settings in the Taplist.io dashboard, or by contacting our support team; cancellation takes effect at the end of the current period.
Location licenses. Paid Services are licensed per location. A location is a single physical place of business, and each physical location where you use the Services — for example, each venue whose menus or screens the Services serve — requires its own location license on your account. You may not use one location license for more than one physical location. Location licenses are billed for the number of licensed locations on your account, prorated when that number changes during a billing period.
Plan eligibility. Some plans are offered only to eligible customers, such as plans for personal, non-commercial use. By choosing a plan you represent that you meet its eligibility requirements, and you agree to tell us if you stop meeting them.
Correcting your plan. If we determine that your account uses the Services at more locations than it is licensed for, or on a plan it is not eligible for, we may, in addition to our other remedies, add the required location licenses to your account or move it to the plan that applies. We will notify you, and the corrected fees apply from your next billing period after that notice; if you do not agree, cancel before they take effect.
Free trials and promotions. A free trial ends without charge; a Paid Service starts only when you subscribe. If a Paid Service starts at a promotional price, we will tell you the length of the promotion, the price that applies afterward, and how to cancel before you provide payment details, and we will remind you before the first regular-price charge.
Fee changes. If we change the fees for a Paid Service you already have, we will give you at least 30 days’ notice by email or in the dashboard, and the change takes effect at your next renewal after that notice. If you do not agree, cancel before the change takes effect. We may begin charging for Services that were previously free, with the same notice.
Non-payment. If your payment fails or is not made on time, we may suspend or cancel the Paid Service. If you reverse or dispute a charge for Paid Services with your bank rather than contacting us, we may suspend your account.
Refunds. Refunds for Paid Services are issued as described in our Refund Policy and otherwise in our discretion, unless required by law.
6. Member subscription payments
This section applies if you offer a Program with paid memberships through the Services.
Merchant of record. When Members pay for your Program through the Services, Splatboard is the merchant of record and seller of record for the subscription charge: we collect the fee from the Member using our payment processor, the charge settles to our account, and we pay out your share to the payout account you connect. You provide the Program and everything it includes — perks, rewards, discounts, merchandise, events, and anything delivered at your venue — and you are solely responsible for delivering and honoring it.
Stripe. Payment processing services for Businesses on Taplist.io are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to these Terms or continuing to operate as a Business on Taplist.io, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of Splatboard enabling payment processing services through Stripe, you agree to provide Splatboard accurate and complete information about you and your business, and you authorize Splatboard to share it and transaction information related to your use of the payment processing services provided by Stripe.
Platform fee and payouts. We retain a platform fee on each Member charge; the fee that applies to your account is shown in your dashboard when you enable payments and is otherwise as agreed with you in writing. The platform fee includes payment processing costs; we do not charge you separate processing fees. Payouts are made to your connected payout account on the schedule shown in your dashboard, after the Member’s payment has settled to us. We may delay, hold, or reserve payouts where we reasonably believe there is a risk of fraud, chargebacks, refunds, or non-delivery of a Program, while a payment dispute is pending, or as our payment processor requires.
Refunds, chargebacks, and amounts owed. Refunds to Members are handled as described in the Membership Terms, and we may issue them in accordance with those terms or applicable law. Refunded amounts, chargebacks, associated processing fees, and any other amounts you owe us are deducted from your payouts. If they exceed your pending payouts, you authorize us to debit your connected payout account, set off against future payouts, or invoice you, and you will pay any invoice within 14 days. You will cooperate with us in responding to payment disputes and chargebacks, including promptly providing evidence we request.
Taxes. Where we are required by law to collect sales, use, or similar taxes on Member subscription sales, we will add them to the Member’s charge and remit them, and you agree to provide the information we need to do so, including your venue’s address and the taxability of your Program’s benefits. You are responsible for all other taxes on your Program and for income taxes on your payouts, and you authorize us to issue any required tax information reports (such as Form 1099-K) to you and to tax authorities.
Alcohol. Splatboard is not a licensed alcoholic-beverage retailer and does not sell, serve, or deliver alcohol. Membership fees you charge through the Services must be for membership itself and for benefits such as merchandise, discounts, events, and access — never payment for alcoholic beverages. You will not offer a Program whose fee is, or could reasonably be treated as, a prepaid purchase of alcohol, and you are solely responsible for confirming with your licensing authority that your Program and its benefits are lawful where you operate.
Your obligations. You will deliver the memberships and benefits you offer; honor cancellations and refunds as described in the Membership Terms; comply with all laws applicable to your Program, including alcoholic-beverage, consumer-protection, and automatic-renewal laws; and publish any additional Program rules on your Program page so Members can see them before joining.
Nothing in this section creates a partnership, joint venture, employment, or franchise relationship between you and Splatboard.
7. Customer Data
This section applies if you store Customer Data — for example, the names, contact details, membership records, and activity of your Members — in the Services.
Your data, our limited role. As between you and Splatboard, you own your Customer Data. We access, use, and process Customer Data only to provide, secure, and improve the Services, at your direction and on your behalf, as described in our Privacy Policy, and as required by law. We act as a “service provider” or “processor” (as those terms are defined under applicable privacy laws) with respect to Customer Data. We do not sell Customer Data, we do not use one Business’s Customer Data for the benefit of any other Business, and we do not use Customer Data for advertising. We will notify you if we determine we can no longer meet our obligations as a service provider.
Security and incidents. We maintain reasonable administrative, technical, and physical safeguards designed to protect Customer Data, and we will notify you without undue delay after confirming a security incident affecting your Customer Data.
Subprocessors and personnel. We use the third-party vendors described in our Privacy Policy to process Customer Data on our behalf; they are bound by written obligations no less protective than this section, and we will notify you by email or in the dashboard before adding a new vendor that will process Customer Data. We limit access to Customer Data to personnel who need it and who are bound by confidentiality obligations.
Your responsibilities. You are the “business” or “controller” of your Customer Data. You represent and warrant that:
- You have provided all notices, obtained all consents, and have all rights and lawful bases required to collect the Customer Data you store in the Services — including data you upload or import about individuals who have not interacted with us directly — and to permit us to process it as described in the Agreement.
- Your use of the Services to contact Members will comply with all applicable laws, including the CAN-SPAM Act, the Telephone Consumer Protection Act, and state telemarketing and privacy laws. You will send marketing messages only to individuals who have given any legally required consent, and you will promptly honor opt-out and unsubscribe requests.
- You will not store in the Services any Social Security or other government identification numbers, payment card numbers, financial account credentials, health information, precise geolocation data, personal information of children under 13, or other sensitive categories of personal information.
Member requests. If a Member submits a privacy request (such as a request to access or delete their information) about your Program or Customer Data, we may route it to you, and you agree to handle it as required by law. We will reasonably cooperate with you, and we may act on requests directed to us where the law requires, after notifying you where permitted.
Export and deletion. You may request an export of your Customer Data at any time. If your account or your use of these features ends, we will, upon request, make your Customer Data available for export for a reasonable period and thereafter delete it, except for records we must retain — such as payment and billing records we hold as merchant of record — and backups that are deleted in the ordinary course.
8. Third-party services
The Services let you connect integrations, embeds, and other products offered by third parties or by you (“Third-Party Services”). Third-Party Services are not vetted, endorsed, or controlled by us; your use of them is at your own risk and governed by the third party’s terms and privacy policy, including how it handles any data you allow it to access. We may not be able to support issues caused by Third-Party Services and may suspend or remove one from your account at our discretion.
9. Beta features and APIs
We may offer features labelled beta, preview, early access, or similar. They are provided as-is, may be changed or withdrawn at any time, may be less reliable than other Services, and are excluded from any support or uptime commitments. If we make an API available, your use of it is subject to any published API documentation and rate limits, and we may suspend API access that burdens our systems or violates these Terms. We may update the Services at any time, and the Agreement applies to any updates.
10. Copyright
We respect the intellectual property rights of others. If you believe material on the Services infringes your copyright, notify us at https://taplist.io/support with the information required by the Digital Millennium Copyright Act: a description of the copyrighted work, the location of the allegedly infringing material, your contact information, a statement that you have a good-faith belief the use is not authorized, and a statement, made under penalty of perjury, that your notice is accurate and that you are authorized to act for the copyright owner. We will remove or disable access to infringing material and terminate the accounts of repeat infringers in appropriate circumstances.
11. Intellectual property
The Agreement does not transfer any Splatboard or third-party intellectual property to you; all right, title, and interest in the Services remain with Splatboard and its licensors. Splatboard, Taplist.io, the Taplist.io logo, and other trademarks, service marks, and logos used in connection with the Services are trademarks of Splatboard or its licensors, and other marks may belong to third parties. Your use of the Services grants you no right to use any of them.
12. Disclaimer of warranties
The Services are provided “as is.” Splatboard and its suppliers and licensors disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be error-free or that access will be continuous or uninterrupted. You obtain content or services through the Services at your own discretion and risk.
13. Limitation of liability
In no event will Splatboard, or its suppliers or licensors, be liable with respect to any subject matter of the Agreement under any contract, negligence, strict liability, or other legal or equitable theory for: (i) any special, incidental, or consequential damages; (ii) the cost of procurement of substitute products or services; (iii) interruption of use or loss or corruption of data; or (iv) any amounts that exceed the greater of $50 or the fees you paid to Splatboard under the Agreement during the twelve months before the cause of action arose. Splatboard has no liability for any failure or delay due to matters beyond its reasonable control. Nothing in this section limits our obligation to pay out amounts we collected from Members on your behalf, less the deductions permitted by these Terms. The foregoing does not apply to the extent prohibited by applicable law.
14. Indemnification
You agree to indemnify and hold harmless Splatboard, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against all losses, liabilities, demands, damages, costs, claims, and expenses, including attorneys’ fees, arising out of or related to your use of the Services, including your violation of the Agreement, your Content, Customer Data you store in the Services or your use of it, Programs you operate and the benefits you offer through them, and any commerce conducted in connection with your use of the Services. We will notify you promptly of any claim for which we seek indemnity and give you reasonable control of its defense, provided you do not settle any claim in a way that admits fault by or imposes obligations on us without our consent.
15. Disputes and governing law
Talk to us first. Before filing a claim against us, you agree to send a written description of the dispute to https://taplist.io/support and give us 30 days to resolve it informally.
Individual claims only. To the fullest extent permitted by law, you and Splatboard may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. Any claim arising out of the Agreement must be filed within one year after it arose, or it is permanently barred.
Governing law and venue. Except to the extent applicable law provides otherwise, the Agreement and any use of the Services are governed by the laws of the State of Delaware, U.S.A., excluding its conflict-of-law provisions. The state and federal courts located in the State of Delaware have exclusive jurisdiction over any dispute arising out of the Agreement, and you consent to their jurisdiction.
16. Changes to these Terms
We may revise these Terms from time to time by posting a revised version. If a change is material, we will notify you — by email, in the dashboard, or by a notice on the Services — before it takes effect and designate a reasonable period after which the new Terms apply. If you disagree with a change, stop using the Services before it takes effect; continued use after that date means you accept the new Terms. Disputes that arose before a change are governed by the Terms in place when the dispute arose.
17. Termination
We may suspend or terminate your access to all or part of the Services at any time, with or without cause or notice, including if we reasonably believe you have violated the Agreement, if your use burdens our systems, or if we discontinue a Service. We may also reclaim a hosted page URL after prolonged inactivity. Except as provided in our Refund Policy or required by law, we have no obligation to refund amounts previously paid.
You may end the Agreement at any time by closing your account or, for Paid Services, cancelling as described in Section 5. Section 7 describes what happens to Customer Data when your account ends. Provisions that by their nature should survive termination — including ownership, payout and set-off rights, disclaimers, indemnity, limitations of liability, and dispute terms — survive.
18. Miscellaneous
The Agreement is the entire agreement between you and Splatboard about its subject matter. If any part of it is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent and the rest remains in effect. A waiver of any term in one instance is not a waiver of that term or any later breach. You may assign your rights under the Agreement only to a party that agrees to be bound by it; Splatboard may assign its rights without condition. You agree to receive notices, receipts, and disclosures from us electronically, at the email address on your account or in the dashboard. These Terms are written in English; any translation is for convenience and the English version controls.
